These Terms of Use ("Terms") govern your use of powerclouderp.com (the "Site"), operated by Power Cloud Consulting ("Power Cloud," "we," "us"). By using the Site you accept these Terms; if you don't agree with them, please don't use the Site. Our Privacy Policy explains how we handle information collected through the Site.

The Site is information, not advice

Everything published on the Site — articles, guides, case studies, assessments, product descriptions, and AI-related content — is general information provided for educational purposes. It is not professional, consulting, legal, accounting, tax, or investment advice, and it may not fit your situation. Decisions about your ERP, your data, or your business should be made with advice tailored to your circumstances.

Reading the Site, taking an assessment, or submitting a form does not create a consulting or client relationship with Power Cloud. An engagement begins only when both parties sign an agreement. Case studies and testimonials describe specific client engagements; your results will depend on your own environment and circumstances.

Using the Site

You may view and share the Site's content for evaluating our services and for other ordinary business or personal purposes. You agree not to:

use the Site for any unlawful purpose;
probe, disrupt, or interfere with the Site or its security features;
scrape, harvest, or republish Site content at scale without our written permission;

The Site and its content are owned by Power Cloud and protected by copyright and other laws. The Power Cloud Consulting name and logo, and our product names — PowerGL, PowerFactoring, PowerLabel, PowerUtilities, PowerBulkOrder, PowerCommitment, and PowerNetting — are trademarks of Power Cloud. Nothing on the Site grants you a license to use them.

Third-party names and trademarks

Oracle and NetSuite are trademarks of Oracle Corporation. Anthropic and Claude are trademarks of Anthropic, PBC. OpenAI, ChatGPT, and GPT are trademarks of OpenAI. Google and Gemini are trademarks of Google LLC. Meta and Llama are trademarks of Meta Platforms, Inc. All other third-party names, logos, and marks that appear on the Site belong to their respective owners.

References to third-party products are for identification and compatibility purposes and do not imply sponsorship or endorsement by those companies. "Oracle NetSuite Alliance Partner" refers to Power Cloud's membership in Oracle's NetSuite Alliance Partner program. Certifications named on the Site (such as Anthropic's Claude certifications) are credentials held by individual Power Cloud consultants.

Third-party sites and embedded content

The Site links to and embeds content from third-party services such as YouTube and LinkedIn. Those services are governed by their own terms and privacy policies, and we're not responsible for their content or practices.

Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POWER CLOUD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SITE OR ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THIS SECTION DOES NOT APPLY TO SERVICES PROVIDED UNDER A SIGNED ENGAGEMENT AGREEMENT, WHICH IS GOVERNED BY ITS OWN TERMS.

Indemnification

You agree to indemnify Power Cloud against claims and costs (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Fort Bend County, Texas, and you consent to their jurisdiction.

Changes, severability, and the rest

We may update these Terms from time to time; the "Last updated" date above reflects the current version, and continued use of the Site after a change means you accept it. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms are the entire agreement between you and Power Cloud about use of the Site — they do not modify any signed agreement between us.
